Welcome to Cascadia Analytics ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of https://cascadia-analytics.pages.dev and the Cascadia Analytics Pro subscription service (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1.Educational and Informational Purposes Only (No Financial Advice)

1.1. Not Investment Advice: All content, data, charts, financial models (including DCF valuations), and tools provided through the Service are for educational, informational, and research purposes only. Cascadia Analytics is not a registered investment advisor, broker-dealer, or fiduciary.

1.2. No Recommendations: Nothing contained in the Service constitutes a solicitation, recommendation, endorsement, or offer by Cascadia Analytics to buy or sell any securities or financial instruments.

1.3. User Responsibility: You acknowledge that investing in securities involves high risk, including the loss of principal. You are solely responsible for evaluating the merits and risks associated with the use of any information provided. We strongly recommend consulting with a qualified financial professional before making any investment decisions.

2.Subscriptions, Billing, and Cancellation

2.1. Subscription Plans: We offer a paid monthly subscription ("Cascadia Analytics Pro") as well as free tiers of access. By subscribing to Cascadia Analytics Pro, you agree to pay the monthly subscription fee of $19.00 plus any applicable taxes.

2.2. Auto-Renewal: Your subscription will automatically renew each month on the calendar day corresponding to the commencement of your paid subscription. Your designated payment method will be charged automatically unless you cancel prior to the end of the current billing cycle.

2.3. Cancellation: You may cancel your subscription at any time through your account settings or by emailing justin@jda-properties.com. Cancellation will take effect at the end of your current paid billing period. You will retain access to the Pro features until that period expires.

2.4. No Refunds: All subscription fees are non-refundable. We do not provide refunds or credits for any partial-month subscription periods or unused Services.

2.5. Price Changes: We reserve the right to modify our subscription prices at any time. We will provide you with at least 30 days' advance notice of any price changes.

3.User Accounts and Security

3.1. Registration: You must provide accurate and complete information when creating an account. You are strictly prohibited from sharing your login credentials with third parties.

3.2. Account Termination: We reserve the right to suspend or terminate your account at any time, without notice or liability, if we determine you have violated these Terms (e.g., sharing an account or scraping data).

4.Intellectual Property and Acceptable Use

4.1. Ownership: All proprietary algorithms (such as the Alligator Jaw gauge), financial models, software, site design, text, graphics, and interfaces are the exclusive property of Cascadia Analytics or its licensors.

4.2. Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use only.

4.3. Prohibited Conduct: You agree not to: Use automated scripts, spiders, or scrapers to extract data, models, or pricing information from the Service. Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service (including premium data) without express written permission. Use the Service to build a competing product or service.

5.Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE DATA WILL BE ERROR-FREE, ACCURATE, TIMELY, OR UNINTERRUPTED. MARKET DATA MAY BE DELAYED.

6.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CASCADIA ANALYTICS, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO TRADING LOSSES, LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7.Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in King County, Washington.

8.Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Continued use of the Service after any such changes constitutes your consent to the updated Terms.
